Q: Kolkata complaint case – warrant recall & exemption advice
A criminal complaint case (CS) is filed against me in Kolkata Magistrate Court relating to an NBFC loan. I never received any summons. The case status shows “E/R of Warrant” with next date 21-04-2026. Recently, Bangalore police contacted my family but did not show any warrant, only gave intimation and suggested settlement. I live outside West Bengal. Can you appear before the Kolkata court now to file warrant recall and exemption from personal appearance? Please advise process, urgency, and fees

I deny all allegations made against me.The alleged complaint case pending before the Learned Magistrate Court at Kolkata relates to a financial dispute and is purely civil in nature, though given a criminal colour.I state that I have never been served with any summons or notice from the said court. Any issuance of warrant without proper service of summons is bad in law and is liable to be recalled.I am a permanent resident outside the State of West Bengal and have never willfully avoided the process of law. I am in the process of taking appropriate legal steps through my advocate for recall of warrant and exemption from personal appearance under Section 205 CrPC before the concerned court.I further state that any attempt to coerce, threaten, or pressurize me or my family members in the name of police action or settlement, without showing a valid warrant and following due process of law, shall be illegal and will be dealt with strictly in accordance with law.All my rights and remedies are reserved.
