Q: Kolkata complaint case – warrant recall & exemption advice

A criminal complaint case (CS) is filed against me in Kolkata Magistrate Court relating to an NBFC loan. I never received any summons. The case status shows “E/R of Warrant” with next date 21-04-2026. Recently, Bangalore police contacted my family but did not show any warrant, only gave intimation and suggested settlement. I live outside West Bengal. Can you appear before the Kolkata court now to file warrant recall and exemption from personal appearance? Please advise process, urgency, and fees

Advocate Sanjana Basak answered
dear Client,Since the case shows “Execution/Return of Warrant,” this is a serious and urgent matter. However, since you were never served with summons, the warrant can be recalled and your personal appearance can be exempted.Immediate Legal Remedies:File a petition under Section 70(2) CrPC before the concerned Kolkata Magistrate for recall/cancellation of warrant, explaining non-service of summons.Simultaneously file an application under Section 205 CrPC seeking exemption from personal appearance, especially since you reside outside West Bengal. If police harassment continues or coercive steps are taken without producing a warrant, a protective petition/anticipatory bail can also be considered. If the complaint is under Section 138 NI Act, scope for compounding/settlement remains open at any stage.Urgency:Please act before the next date (21-04-2026) to avoid arrest, coercive steps, or escalation into a non-bailable warrant.Fees:Fees depend on the court, urgency, and number of applications, but I offer affordable and transparent charges after reviewing case documents.

Q: Had Intimate chat with a below 18 year girl wrongly

Actually I had some mutual sex chat with a girl , but didn't shared any photos or didn't even met with her.....all this happened when she was 17....now she is 18.....now my question is is this punishable under pocso act or not if her parents. Complain now or police will just give me some warning for this....please help

Advocate Sanjana Basak answered
Mutual sexual chats with a minor (below 18) can fall under POCSO even if no photos were shared and no meeting took place, because “sexual communication with a child” is treated as sexual harassment under the Act. However, since you stopped the chats immediately after knowing her age and no explicit content was exchanged, the police generally verify both sides and may close the matter if there is no exploitation. If her parents complain later, you will need proper legal defence to avoid unnecessary charges and protect your rights. I can help you with preventive legal steps, drafting your defence, and guiding you safely through the process. Reach out for detailed guidance in a confidential manner. Q: Quashing Case U/s -420,468,469,470,120(b)

Two case lodged for same cause of action in two different court. It was a job fraud case. I have made an settlement with Complainant. Kindly guide me to quash case. There are 4 co - accused in this case. Chargesheet was filed on 2017.My phone no - 9051448382

Advocate Sanjana Basak answered
Dear Client,Since two FIRs are filed for the same cause of action, you have a very strong ground to approach the High Court for quashing under Section 482 CrPC/BNS, because double prosecution for the same incident is not legally permissible. Since you have already settled the matter with the complainant, the High Court normally quashes such cases, even if other co-accused exist.I can help you draft the quashing petition, collect settlement proof, and ensure that both FIRs or the duplicate/chosen FIR stands quashed in a single hearing. If needed, we can also request no-objection from the complainant, which speeds up the quashing. I will guide you step-by-step, including drafting, filing and representation. For detailed help you can contact me at IX-I-VI-III-O-VI-V-O-II-II.
