Is partial quashing of FIR (IPC 354, 509, 323) possible?

My neighbour abused and attacked a lady in the colony. The lady filed an FIR against him and put my name also in the FIR. There were video cameras and I have proof of my innocence. Police has framed charges against my neighbour but put me in column 12 in the charge sheet due to lack of prima face evidence.Now, my neighbour did settlement with the lady and is going for quashing of the FIR in high court and says that if I don't file a petition separately, my name would remain and his name would be removed from the case. Is partial quashing even possible?

If your name is also mentioned in the FIR then you should also file your name in the same quashing petition that ought to be filed by your neighbour and if you had sufficient evidence to prove your innocence then you must have convinced the police officials before filing of the chargesheet. Partial quashing is not possible via one accused if there are more than one. Therefore you need not to worry. This type of conspiracy seems to extort money or to harass someone. If police have not made you accused in the chargesheet you are already out from this case. B in touch

partial quashing is very much possible. If the other person goes for a 482 quashing petition in the High court the case against him might be quashed. if you want the case against you to be quashed then you will have to go for a seperate Petition under 482 before the Delhi High court to quash the case against you.
