Eye witnesses are not the sole criteria to convict a person but it’s importance can’t be ignored by the court. After the chargesheet is filed by the police officials then all the witnesses are examined and you will be given full chance to cross examine him/her and catch his/her lie. Yes there is a chance of conviction of your brother if you don't cross examine the witness properly. It is necessary to ask the right question to the witness so that truth can come out before the court
