Im convicted in Sec 138, appealled, want to withdraw after 7 years.
28-Dec-2023 (In Criminal Law)
in 2013, I was convicted in trial court under sec 138 of Negotiable instrument act for dishonouring cheque for Rs 14000/-. Order of the trial court was- Impressionment of 3 months or Penalty of Rs 25000/- and penalty amount to be given to complainant
So I deposited the penalty amount Rs 25000/- in court and apealed against the order, in the apealate court.
its now almost 2020, the same case is in appleate court and now I want to withdraw. Can I withdraw it smoothly?
if the punishment was or then after payment of penalty need for going for appeal. you would have paid amount in the lower court and no need of appeal. however if the conviction is and i.e both imprisonment and penalty you need to wait for appeal to be decided or the respondent can go for settlement
Yes, you can withdraw the case stating reasons as such that 'Why you want to withdraw?' You can contact me for filing a Withdrawal Application & as such, you'll be hassle free & can concentrate on other important aspects of your life.
