Hi, I'm an eye witness to a groping case that happened in Delhi in 2019 and I gave my statement in the FIR back then. I'm being summoned now by the court. Want to know if I can withdraw myself as the witness from this case or refuse to testify? This is because I no longer live in Delhi and have shifted to Bangalore. If yes, can you please share the process? Also, can I have an advocate file these requests for me? thanks

Dear Sir, You may request concerned Public Prosecutor through your friend or through Police or directly who is conducting that case. The Public Prosecutor has every liberty to give up your name to examine as a witness. You may give valid reasons as to why you are not interested to give evidence before the Court otherwise warrants will be issued against you.
