I transferred 12.5 lakhs for buying flat

hi sir/madam, I transferred 12.5 lakhs to a close friend of mine against a false promise of getting a flat from him. money was transferred via net banking in may 2019, i have all the bank details & phone chat details with me. on august 2019 the said person died, i contacted his wife who initially asked for time and later started ignoring to return my hard earned money. pls advice what can be done [email protected]

Sorry to know about your situation. You need to initiate legal proceedings against his legal heirs. First send a legal notice through a counsel asking for return of your money from them by giving a time. After expiry of that time period you may file a suit....

you can file suit for specific performance, possession, compensation and also for injunction against your friend legal heirs. before file suit you have to Send legal notice to said party. did you make any agreement or promissory note. can you provide me details information and documents. thank you.

You can file a criminal complaint against them or else you have to file suit for recovery of Money.

A Summary Suit can be filed against an heir and legal representative of a deceased defendant and the provisions of Order XXXVII apply in full to such a suit also. The decree however, can be executed only to the extent of the estate of the deceased in the hands of the judgment debtor.
