Since you have already submitted complaints to the police and senior police officers and no action has been taken for 30 days, you can consider approaching the Magistrate under the applicable provisions of the BNSS seeking appropriate directions for registration/investigation of the offence, depending on the facts and evidence. A specific threat to kill can constitute criminal intimidation, and the exact offence depends on the words used, circumstances and supporting evidence. As a senior citizen, you may also seek appropriate protection if there is an immediate threat to your safety. Keep copies of all complaints, acknowledgments, recordings/messages and other evidence. Please visit the office for further assistance and to take appropriate legal action.

You can hire a lawyer to file a request directly with a local magistrate (judge). The judge has the power to order the police to immediately register an official case (FIR) and start investigating. Start a Formal Eviction Case: Do not try to force the tenant out by talking to them. Have a lawyer send them a legal eviction notice. If they do not leave, file a proper eviction case in court. You can approach a magistrate under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita (BNSS)—formerly Section 156(3) of the CrPC—to direct the police to register an FIR when the local police fail to take action on a criminal intimidation complaint. Legal Steps to Take Private Complaint: File a direct complaint before the jurisdictional Judicial Magistrate of First Class under Section 223/200/226 of the BNSS highlighting the criminal intimidation and threat to life. Legal Notice / Eviction Suit: Initiate proper civil or rent control proceedings through a lawyer to legally evict the tenant rather than relying solely on verbal requests. Have you got written rental agreement.

Dear sir , you shall approach the court for an eviction suit , it's a civil case as well as involve the rent control act , criminal liability for threatening is maintainable , under BNS hence if police are not taking an FIR try with Zero FIR even if it's not working you need to approach the magistrate of your jurisdiction to register an fire , the court will give direction orders to SHO regards,

Yes, you can take further legal action. Threatening to kill someone can be a criminal offence under Section 351 of the BNS. Since you are 76 years old and the SHO has not taken action even after 30 days: Keep copies of all complaints given to the SHO, ACP, DCP and Commissioner. Send a written complaint to the SP/Commissioner asking for immediate action and protection. If the police still do not act, you can approach the Magistrate under Section 175(3) of BNSS and request the Court to direct the police to investigate. You can also request police protection because you have received a death threat. The tenant eviction issue is separate. For vacating the tenant, appropriate proceedings under the applicable tenancy law should be taken. if you have any further queries please feel free to contact me.
