I have Registered a FIR Sec 419 & 420 & Now the Chargesheet Submitted
08-Feb-2023 (In Criminal Law)
I have registered FIR under section 419 and 420 and now the charhesheet is submitted in lower court in month september 2019. My concern is lower court is giving date every after 3 month and now the date is on 13 march 2020 and the persons whose name were there in the FIR are not appearing in front of court. Before Chargesheet the same persons and culprits gone to Allahabad highcourt for arrest stay but highcourt not given them arrest stay till the chargesheet. Now in chargesheet there crime under 419 and 420 found guilty as per the police investigation. My main concern is chargesheet is submitted in court almost 6 months has been passed and they are not getting arrested yet. Please guide me what should I do?
unfortunately this is the most ugliest part of the court for delay you cannot do anything it's all about burden of the court you can pay some amount to the court secretary and manage some early dates and your consern for arrest is justified they will be only arrested if they appear in court or wait until order under section 85 is passed by the court for attachment of their property
shall they get any relief from high court?. may police investigation is complete and police submitted the chargesheet ground of noice section 41 of crpc. now case totally in court hand need to release NBW from the court for arrest of culprits. for more information you can contact me.
