I have filed a written complaint of fraud in the police station along with all the valid proofs like bank statement through a criminal lawyer of high court. Also I have receiving of the complaint file.. but it's been one month and police had not taken any action like atleast filing an fir.. when I consult to my lawyer he says that there is a directive of supreme court that no fir can be registered in case of 420 until the police investigate the matter within a period of 2 months.. after 2 months he can take a legal action the police in Court.. is that true? Or my lawyer is bluffing..(he says he is following the proceedings).. is it really very difficult to file an fir in fraud case even after having all the proofs.. kindly tell me all the legal proceedings in this matter.. so that I can be sure that my lawyer is not bluffing and I can cross check with his proceedings..

there is nothing like that fir can not be filled before investigation rather investigation starts after filling fir. lodging the fir is your basic right which can not be denied and police is under obligation to file the fir. but if police don't file fir you can move to court and exert pressure on police under 156(3) for filling the fir even you can directly file the complaint case in this regard even with out filling the fir and court will summon the accused you can meet to higher police officials also in this regard but in anyways fir can definitely be filled their is no such thing which is told by your lawyer to you

Dear Client, If this query regards to the competency of your counsel is engaged, i will not comment upon his competency, however if this pertains to the non filling of a complaint as an FIR then there are several other modes and ways in law by which your complain will be lodged. Regards
