Dear client based on your question, First you need to confirm if the drink and drive case has any implications in the ownership transfer of the vehicle. And if the vehicle is under any court orders or has been seized, its transfer might not proceed smoothly. For future legal advice feel free to contact us.

If the second-hand vehicle you purchased has a pending drunk and drive case against the first owner, it is essential to proceed cautiously. Here’s what you should consider: Pending Case: The drunk driving case is against the individual (the first owner) and not the vehicle itself. However, the vehicle may be involved as material evidence in the case. Ensure that the vehicle is not seized by the court or the police as part of the ongoing proceedings. Registration in Your Name: While the dealer claims they will transfer the registration, it is advisable to verify with the Regional Transport Office (RTO) if there are any restrictions or objections on the vehicle's transfer due to the pending case. Written Assurance from the Dealer: Obtain a written undertaking from the dealer stating that they will resolve any legal or procedural issues related to the vehicle and indemnify you against any claims arising from the pending case. Legal Advice: Consult a lawyer to ensure there is no risk of the vehicle being seized or you being implicated in any legal issues related to the case. Let me know if you require help drafting a legal notice to the dealer or any further assistance.
