I am facing a matter under the section 498a 509 3/4dv

My brother got married on july10 2016 girl went to honeymoon and returned back on 26th july after 5 days she started abusing my mom dad grandmother and called her parents claiming assault she lEFT with his father on 5th august.latee on my brother told shw was torturing him everyday for ggetting separated from parents threatening for case n all and was abusing each and every family member.our only fault in this all case is we took 115000 by neft into one of my other brother account in which her parents urged to buy jewellery for her daughter(we have bills in her name)and make arrangements honestly we spend all the money in her dresses jewellery n marriage since they did not gave anything else even in name of gift.aftee they have filed case on section 498a 509 n 3/4dp an arrest warrant is issued against my bro mom dad uncle brother in law n other bro.how to get rid of this case at earliest.all charges framed except above are baseless in single month we uses to keep her like princess

Hi,

First of all get an appropriate bail.

Second you will have to file a quasi petition before the high court to ensure that the case is dismissed.

Do not panic. You will be able to come out of this fake complaint by taking the right steps.

Sir once filed FIR against you and your family member you have to prove your side and based on the document and evidence you can win the case an can get the bail or Antispatory bail if police did' nt arrest .

There is a way. it is called raising a "discharge plea" against the cases. If you have the basic evidence that the gold ornaments were purchased in the name of the bride, then you may get discharged of all the cases against you.

To avoid such false allegations the Supreme Court (SC) has issued a direction in a recent case with few guidelines. SC guidelines restricts arrest in such cases before a preliminary report by a committee constituted under the direction. So you can explain the above facts before the committee the arrest warrant issued should be issued based on the committees report. As a preventive measure you can file an anticipatory bail in this case as a arrest warrant is already issued.
