I am being threatened for a Google review posted online

19-Apr-2023 (In Criminal Law)
I bought a flat in 2015 for which the seller's realtor agency overcharged me but I had accepted the price as I was short on time. Recently I consulted a lawyer informally attached to the seller's realtor agency who was very disrespectful to me, made me wait for more than an hour while she made personal phone calls and ten charged me 1.5 times the regular fees for the consultation. I was very disturbed and left a one line review on the realtor's website that I don't recommend their realtor or legal services. I deleted the review the same day as I didn't have the time to explain things. The realtor called me later and without allowing me to explain, has threatened to sue me for 1 crore. How can I protect myself? Would appreciate any advice.

When there's option for submitting review you have all the rights to record the same as per your experience. It's not mandatory that you should submit positive review only. If the realtor files a case against you then he will be the one who will be exposed. At this juncture you can send legal notice to him explaining everything to safeguard yourself.

I would like to give two advices here sir. first there is no hard and fast rule to determine what an advocate charges and so don't worry that the Advocate charged more. second one is regarding the threatening you got from that person, don't worry about that sir, you have not commited any wrong. The only way he can sue you is by saying that you have committed the wrong of defamation under sections 499 and 500 of Indian penal Code,1860. section 499 of Indian penal code also provides exceptions, that is in few mentioned circumstances a person will not be considered to do a wrong of defamation even though he have defamed someone. That exceptions grant you freedom to give Bonafide review about anyone in a public forum. You have gave your opinion about the agency in a Bonafide manner with respect to your experience and that is why there is a review section. It is your right to express your opinion under the Article 19(1) of constitution. You have been granted freedom of speech and expression under our constitution. So you need not worry about any legal implications. You have exercised your constitutional right and nowhere commited a wrong. If a case is filed against you, need not worry, you will not be convicted. Any ordinary advocate can bring you out of this. You can be chill.
