How to transfer a criminal case ?

31-Jan-2023 (In Criminal Law)
Hello Sir, I am married since 2012. i have 4 yrs old kid. Due to bad attitude of my wife she has undergone so many counselling religiously and constitutionally. Since Dec 2013 she is not living with me. She harassed me & my family by police through year 2014. In Dec 2014 her family came and attacked me, my mom and my father infront of police station. We have lodged a case against her two uncles under IPC 323 which is under trial. Till now there is no case registered against us but, two days back they send D.V notices to me, my family and my sisters. We are not safe to attend the case in their home town because of life threat. My question is can we transfer case to other location. Because they attacked in my hometown 20 mts far from police station. due to this my father has 3 rib fracture. I am ready every case but not in their hometown. Please guide me as soon as possible.

Hi
you can file a transfer petition in high court under Section 24 of Cpc and request the high court to transfer the case from their native place to your native place or any other neutral location as you and your family members were attacked when you had been to their native place . you need to provide copies of medical reports, FIR, charge sheet of the case filed by you to prove that you were attacked and hence request transfer.
