how to stop febrication and art work in residential area

fabrication and art work factorty typs of shop has been opend in our house sence 2 year,there is noise from above and smell of chemical colour is there, we are worried, we have fild a complaintin NMC ,no action has been tekan since 2month ,his officer telling me as per the low 54dc lower than sound his cant do any action. what should i do in this condition ?

Even after filing complaint before Municipal corporation no action has been taken against the fabrication work you can even approach the police authorities and lodge complaint. You have to seek orders from the court against the ongoing work to stop carrying on the further work.

Well, you can pursue a lawsuit of Private Nuisance in the concerned Court and plead Court to grant you monetary compensation under Sec 73 of the Indian Contract Act, 1872 within a prescribed limitation period or can seek an prohibitive injunction for factory to reduce noise from their above factory and use certain mesures, so that, chemical smell does not reach out at your place.
