How to seek Bail bond modification in 498a case

05-Jul-2023 (In Criminal Law)
My wife (married to me under HMA) lodged a frivolous case against me and all my family members u/s 498a, 323. I got anticipatory bail for my parents. However, I'm finding it impossible to meet the conditions of the Bail bond that mentions that 1 out of 2 guarantors for each petitioner must be a Local Relative with "Immovable property". I'm not able to find such a guarantor. The primary hurdle is Immovable property clause. So, what should I do if I'm not able to meet the terms of the Bail bond as mentioned in the bail order? Should I seek a revision from High court since lower court has refused to modify the terms?

Yes, your parents can certainly move before the Ho'nble High court against imposition of unjust condition for furnishing bail bond by the Court below and from there your parents can get relief and thereafter they will be able to furnish Bai bond.

For just , proper and legal opinion of your query one need to go through the bail order. However, what you mentioned in your query is correct then you have no other option to move before High Court for modification of the order.
