How to prevent false SC/ST case while complaining against a SC/ST pers

As an advocate, I would suggest that you do not take any action merely on the basis of the person’s surname or your assumption about his caste. His caste status should be verified only through legally valid records, and the SC/ST (Prevention of Atrocities) Act should not be treated lightly. If you apprehend that a false complaint may be filed against you, take preventive legal steps immediately: Keep proper evidence of the fact that the cattle have been tied in front of/around your house for the last three years, such as dated photographs, videos, CCTV footage and messages. If the cattle are causing obstruction, nuisance, sanitation problems or creating any threat, submit a written complaint to the concerned Police Station and/or Municipal/Local Authority. Obtain an acknowledgment or keep proof of submission. If there have been threats, abusive behaviour or any dispute with neighbours, maintain a written record and make a preventive complaint to the police before the situation escalates. Do not abuse, threaten, insult or make any caste-related remark against the person. Avoid direct confrontation and communicate only in a lawful and peaceful manner. If you genuinely apprehend a false criminal case, consult a local criminal advocate immediately. Depending upon the facts and the exact allegations, appropriate preventive remedies and, where legally maintainable, anticipatory-bail/protective remedies can be considered. If a complaint is actually filed, do not panic or try to influence witnesses. Your defence should be based upon documentary evidence, CCTV footage, independent witnesses and the circumstances showing that the allegations are false or motivated. Most importantly, do not make any allegation that the person is falsely claiming SC/ST status merely because of his surname. Deal with the actual nuisance and any illegal conduct through proper legal channels. If you provide the exact facts, location/state and what the person has been doing in front of your house, I can suggest the appropriate legal remedy and also draft a preventive complaint/application for you.

The first step is not to take any action against the person merely because you suspect that he may belong to SC/ST or may file a false complaint. His caste by itself has no legal relevance unless the ingredients of a specific offence under the SC/ST (Prevention of Atrocities) Act are actually made out. You should immediately start maintaining evidence regarding the cow being tied/kept near your house—take dated photographs/videos, preserve CCTV footage, and keep records of complaints or requests made to the municipal authority/police/RWA regarding the nuisance. If possible, make a written complaint regarding the obstruction, sanitation or nuisance caused by the cow, without making any caste-related allegation or abusive remark. Most importantly, do not argue with him, threaten him, use caste-related words, or post anything about him on social media. If a complaint is subsequently filed, the defence can be based on the actual allegations, available evidence, CCTV footage, independent witnesses and whether the statutory ingredients of the alleged SC/ST offence are satisfied. If an FIR is registered, immediately obtain its copy and consult a local criminal lawyer. Depending upon the sections invoked and the facts, appropriate proceedings such as anticipatory bail (where legally maintainable), quashing or other remedies may be considered. A mere apprehension that someone may file a false SC/ST case does not itself establish an offence or require taking coercive action against that person.

If you are prompt in filing your case and specifically mention in your complaint that this person threatened me with filing a false case under the said provision of law it gives you a defense You can’t per se prevent them from filing a case but you can’t always make your defense before they do so
