नमस्कार,यदि आप दोनों हिंदू हैं और विवाह करना चाहते हैं, तो आर्य समाज मंदिर में विवाह करना एक विकल्प हो सकता है। विवाह के बाद विवाह का कानूनी पंजीयन (Marriage Registration) कराना महत्वपूर्ण है।ध्यान रखें कि “आर्य समाज विवाह” और “कोर्ट मैरिज” एक ही प्रक्रिया नहीं हैं।यदि पहले आर्य समाज मंदिर में हिंदू रीति-रिवाज से विवाह हो जाता है, तो सामान्यतः उसके बाद Hindu Marriage Act, 1955 के अंतर्गत Marriage Registration/Certificate कराया जाता है। ऐसी स्थिति में दोबारा कोर्ट मैरिज करना आवश्यक नहीं होता।दूसरा विकल्प यह है कि यदि आप बिना धार्मिक समारोह के सीधे वैधानिक विवाह करना चाहते हैं, तो Special Marriage Act, 1954 के अंतर्गत Marriage Officer के समक्ष विवाह किया जा सकता है। इसमें निर्धारित कानूनी प्रक्रिया, नोटिस एवं अन्य आवश्यक औपचारिकताएँ पूरी करनी होती हैं।इसलिए पहले यह तय करना जरूरी है कि आप आर्य समाज में विवाह करके उसका रजिस्ट्रेशन कराना चाहते हैं या Special Marriage Act के तहत सीधे विवाह करना चाहते हैं।आप अपनी उम्र, दोनों का धर्म, वर्तमान वैवाहिक स्थिति और किस जिले में विवाह/रजिस्ट्रेशन करना है, यह बता दें, तो मैं आपको पूरी प्रक्रिया, आवश्यक दस्तावेज और अनुमानित समय/खर्च के बारे में सही मार्गदर्शन दे सकता हूँ।

Q: How to prevent false SC/ST case while complaining against a SC/ST pers

A person from other colony is knotting his cow in front/ around my house from 3 years and is unfearful of any consequences. I doubt he is a SC/ST person by using the surname Solanki who are also rajputs. And a few of neighbours are also supporting him. How can I save myself from a false SC/ST complaint against me if he files. He has enough false witness who can say for him. What to do, please suggest. Tq

As an advocate, I would suggest that you do not take any action merely on the basis of the person’s surname or your assumption about his caste. His caste status should be verified only through legally valid records, and the SC/ST (Prevention of Atrocities) Act should not be treated lightly.If you apprehend that a false complaint may be filed against you, take preventive legal steps immediately:Keep proper evidence of the fact that the cattle have been tied in front of/around your house for the last three years, such as dated photographs, videos, CCTV footage and messages.If the cattle are causing obstruction, nuisance, sanitation problems or creating any threat, submit a written complaint to the concerned Police Station and/or Municipal/Local Authority. Obtain an acknowledgment or keep proof of submission.If there have been threats, abusive behaviour or any dispute with neighbours, maintain a written record and make a preventive complaint to the police before the situation escalates.Do not abuse, threaten, insult or make any caste-related remark against the person. Avoid direct confrontation and communicate only in a lawful and peaceful manner.If you genuinely apprehend a false criminal case, consult a local criminal advocate immediately. Depending upon the facts and the exact allegations, appropriate preventive remedies and, where legally maintainable, anticipatory-bail/protective remedies can be considered.If a complaint is actually filed, do not panic or try to influence witnesses. Your defence should be based upon documentary evidence, CCTV footage, independent witnesses and the circumstances showing that the allegations are false or motivated.Most importantly, do not make any allegation that the person is falsely claiming SC/ST status merely because of his surname.
