what is the procedure of dowry and domestic violence case? Is the dowry and domestic violence case a non bailable one? within how much time can the accused be arrested after the fir is lodged? what can the accused family do if they are innocent? this is hindu family

Dear sir,

What is the whole matter explain in detail. If its a cause of concern and FIR is registered in police station the accused persons involved will be arrested immediately . What charges are being framed can be seen only through FIR copy. Please discuss the matter immediately. Thank you for writing.

Domestic violence case is not a non bailable case. Where as dowry harassment case is a non bailable case where police can arrest without warrant. It is always advisable to apply for anticipatory bail to protect yourself from arrest.

It depends on the particular sections. If the offence is nonbailable, then you can obtain the Anticipatory bail from the court. If you are arrested then you need to apply for the regular bail.
In domestic violence case, after submission of the dir, the court will issue the summons and you need to appear before the court.

The procedure for dowry demand redress is to file the First Information with the Police, who take care of every thing. For having redress of you grievance under the domestic violence, approach an advocate who will assist you. Arresting of the accused depends on the incriminating evidence. If the accused family do if they are innocent, contact advocate of your choice. Both laws are not personal laws, applicable to Hindus also. The time for getting bail, depends on the advocate, whom you engage.
