How to get justice when police not finishing inquiry in abetment case?

17-Oct-2023 (In Criminal Law)
My mother committed suicide under pressure from the in laws of my brother as there was disputes in their marriage and disagreement on who will keep her grandson (whom she was never able to see). we have registered a FIR including 5 members of my brothers in laws under IPC 306 , 36 on the same date of death , after wards they have got a inquiry against the FIR which the DSP of the region is conducting. For that inquiry DSP has taken the statements of all concerned. today it has been more than 3 months and the police has neither filed the charge sheet nor finished the inquiry instead the are asking us to do compromise as there is huge pressure from the political people on them form the other side. what are the chances DSP can quash the FIR and the case will not see the light of day ?

Hi,
You need to File a separate complaint against the DSP and moreover need a Lawyer to represent the court and convey all the hardships which are being faced by you.

Meet good advocates of your region. These kind of query can not be answered on such platform. If you are serious about pursuing the case, meet advocates in Person and give all the relevant details. The advocate will be able to guide you as to how to move further in the FIR which is already registered.

DSP has no power to quash the FIR without the order of the High Court. Secondly, you can file an application under section 156(3) of the Code of Criminal Procedure before the Magistrate to get an order of proper investigation. For now, you must file this application which will ensure that the Police does not conduct the investigation with a bias.

You can file an application in the concerned court seeking status report of your case. After filling of application it is the duty of the investigating officer to file the reply in the court . This will help you.

Yes DSP can quash the FIr we need to see clearly and discuss the case throughly so that we can get justice as per the law of the land . Police cannot harass you as no court of law encourages someone to act against law.
