How to get a case dismissed after getting a stay from high court?

There is a case on group of 4 people in a district court. One person gets a stay from High Court, there is no counter affidavit submitted by Govt. Advocate. Also, the tie given by the High Court is also finished. In that case, that individual can submit an application in High Court for dismiss the case on that person, who got stay. If not than, how can he will be free from the case individually. NOTE: That individual has neither any contact with other 3 people nor he know them.
on what grounds the stay has been granted by the Hon'ble High Court is to be determined. in case the time has lapsed to file counter then the right of the person shall be closed. you can argue the matter and file an application for dismissal of suit or you can argue on vacation of stay.

He can make an application for separate his file and than he can file documents and conclude evidence to get the case decided but if he got stay from high court than lower court will not proceed in that case
