How to Cancel Mediation

Few years back, One of my friend stole some of my blank cheques and bounce and lodge 138 NI Act case, also filed recovery civil suit same year, in Mumbai. I am a businessman and used to do business in Mumbai & Kolkata. Cheque was from Kolkata SBI Branch. I, hired several lawyers. As I busy in my business those lawyers didn't appeared properly. I also told them to revert this case back to Kolkata, as per latest Supreme court cheque bounce law. But they didn't. Before final argument, my opponents influence me to settle, and made some promise to me.Then we go for mediation. Just after mediation that person still creating problems for me, also threatening me, and so now I cancel that mediation. One of my friend also told me that it is possible.But I am not sure. 1)Can I cancel my mediation? 2)If there is penalty, ho much? 3)Can I transfer that case to Kolkata (Mediation done just before Statement of Accused stage) Thanks

yes you can transfer it to kolkata as well as cancel it through your lawyer. mediation happens between 2 person or parties I have never heard off thats cancelling mediatiopn can cost i feel you are highly misguided.

MY OPINION THAT you have the merit to move at Kolkata jurisdiction absolutely & positively as you can & if you think & if you have sufficient clause & ground that you have cancel the mediation as well as if you have established that the you have sufficient ground /grounds to cancel the mediation then penalty should be relaxed and you can transfer the case at Kolkata high court, i can help you,contact with me.

No, you can not cancel the mediation. You can transfer the can in Kolkata. Yes, there is a penalty and that will be decided by the Ld. Court. You can haress the accused by filing section 420 IPC. Also a civil suit is pending and you can also claim compensation from the accused. The accused will be imprisoned.
