How to apply for quashing of fir area manager filed case

Sir I am working in food corporation of india. We have caught a security guard while stealing rice bag. But prior to that very high shortage was thare . Our area manager filed a case against four persons including me for theft. I was not having any charge of godown. I am not stock holder. And that day we only caught the thieves but instead of our name they have given other person name for catching the thieves. Now I want to know can I go for quashing this fir. And how much chances is thare.

Response --- If the investigation has not yet started, you can file a 482 Petition and also ask for stay on further investigation

You have to go through the trial stages at court to prove your innocence. Otherwise If you have any substantial proof to show that you are not guilty approach High Court under Section.482 by filing Criminal Petition for seeking quash to get immediate remedy and advocate will advice you to take proper step by perusing your case documents,hence contact advocate.

Hi, You will have 100% chance of quashing of the FIR as you said you were not on charge of godown on the specified date and I believe there are no audio/video proof attached with FIR. But, after seeing FIR I find out more grounds for quashing the FIR. You will have better chance to get FIR quashed before police file charge sheet in the court. Ans: if you have documentary or oral proof that you had gone there for catching the thief, or on the basis of the statements made before the police by other witnesses, we can approach the higher court for quashing the FIR in so far you is concerned.

You must posses evidence to show your innocence. if you have got any evidence to show that you are the person who caught the security at the time of committing the theft, give the same to your advocate. He would advise you to move the court to get quash the FIR. Good Luck.
