How is Default Bail Period counted?

Hi, I want to know that if the punishment is less than 10 years, and police do not file chargesheet within 60 days, the accused will get bail. nnBut, How is this 60 days calculated? Is it counted from the date of arrest?

Yes…it is counted from the date of arrest of the person. And if the police officials failed to file the chargesheet within the stipulated period then it becomes the ground for bail. For more legal assistance I am just a call away.

60 is calculated from the date of arrest. if accused has completed 60 days in custody and even after that police is taking time for investigation the the accused person is entitled for default bail as per provision under Crpc.

Sir you need to answer my questions to get a clarity on this concept and you need to tell me the exact date on which the person was taken into custody how many extentions have ben taken by police whether there is an actual ground for default bail .

It is counted from the day he was sent to JC by the court n not otherwise ! Kindly b in touch if the accused seeks regular bail ! Not only time but there are ample legalities to get him out of the jail

Dear client

The date is calculated from the date of the FIR and the default bail is also a discretion of the court. You may take the ground that the final report has not been filed yet however that should not be the only ground as the court has the power to use its discretion to give a final opportunity to the police to file the final report.
