If bail is being delayed despite rejection only once and the accused has no serious prior record, the delay maybe unjustified. File a fresh bail petition citing the delay and violation of personal liberty under Article 21 of the constitution. You may also move the High Court under section 439 CrPC for urgent relief, especially if the accused's co-acused's status is being wrongly used against him. Ensure all facts are clearly stated with supporting documents to press for speedy hearing .

If bail has been rejected once, a second application must highlight any change in circumstances. If your friend's repeated arrests are being linked with your case, it may affect your bail plea. You should file a fresh bail petition citing that you were arrested for the first time and are being unfairly linked to others' cases. Also, approach the Sessions Court or High Court under relevant provisions for speedy disposal. You may also file a writ petition under Article 21 for violation of your right to liberty due to delay.

If bail has been rejected twice and there is undue delay in hearing the fresh bail application, you may immediately move the Sessions Court or High Court under Section 439 CrPC for regular bail, highlighting that this is the accused’s first arrest and he is not a habitual offender. You can also seek urgent listing citing violation of Article 21 (right to speedy justice). Any delay without valid grounds can be challenged before the High Court through a writ petition for expeditious hearing.
