Girls Father caught us intimate and filed a case

I met a girl on a dating app and decided to go on date and kissed. We decided to hookup and the father caught us intimate situation. The case was registered u/s BNS 74 but later at magistrate statement she added few things which added BNS 64. now we are going for quashing but worried about court fees

If the facts are genuinely based on a consensual meeting and the later statement introduces allegations inconsistent with the original FIR and surrounding evidence, quashing can be considered under the High Court’s inherent jurisdiction, but the court will examine the FIR, the Magistrate’s statement and the available evidence carefully. Also, BNS 64 concerns punishment for rape, whereas BNS 74 concerns assault/criminal force with intent to outrage modesty, so the exact allegations and ingredients are crucial

A petition seeking quashing under Section 528 BNSS is a criminal proceeding before the High Court. The exact filing/court-fee amount depends on the High Court and applicable rules, so I would not advise you to rely on a fixed figure quoted generally on the internet. she quashing is a better option for you, don't think about court fees because once your matter gets quashed it will be better for you. but I will suggest you better approach an advocate for better assistance l, if you are from Mumbai feel free to contact me.

As long as the girl is major and is in your favour then there is no need of worry and the fir can be quashed during the charge by jmfc if her statement are against your the case can be defended during trial proving the facts of your relationship and mutual consent

In the criminal cases the court fees involved is minimal around 200 or 400 rupees depending upon the case, might fine both the parties for filing a false case and using the government and statutory bodies for their personal reasons and without having an actual crime, but it will be cost easily if there is a consent of the complainant and the case can be taken back, also physical presence or online presence virtually might be required of the complainant and if it was asked by the hon'ble high court for quashing
