Girl's family file a FIR against boy for denying to marry the girl

16-May-2023 (In Criminal Law)
My friend was in a relationship with his ex girlfriend for 5 years and at the beginning he told her that he will marry her at that time he was in employed but his family was totally against this love due to different casts . But few months ago there relationship has not been much good so the boy told her that he will not marry her now., and even the his family is still against the love and he is employed now. So, the girl's family think that he is employed now that's why he is not marrying her and ditching her and they are threatening him that they will file FIR against him and his family. So I want to know whether is it possible? and what would be the consequences?

Well, your question speaks itself about it's answer. No doubt your friend playing fraud with his Girlfriend. If his girlfriend file a case against him & prosecution success to proof the allegations. your friend will be punished. Conviction will also badly effect his job. In my opinion short out this problem with mutual consent because as you have asked no case has been filed yet now against your friend & this is the right time to take decision wisefully.
More over to know about the consequences, it depends on the allegations made by the informant , chargesheet, evidences etc about which no body can predict without perusal of case record. All the best. For more details plz may consult.
With Thanks.

Dear,
With regards to your question in my opinion it is possible. you can't stop any one to file a false case. .later on it would be matter of police investigation. That time you can take defence before I.O of the case. Under the circumstances my suggestion for you is. ....your friend should file a petition u/s 39 of the Cr. P.C.. . Before the chief judicial magistrate of the District. Or Before the Subdivisional magistrate of the District. Take care. ...

See you have not mentioned what kind of relationship was it if there was physical relationships then you need to worry about because the allegation would be that on the pretext of marriage there was sexual relations and after exploiting there is refusal of marriage therefore fir can be loged

If they lodge the FIR, things will turn nasty.
It is advisable to take steps to gather evidences first and initiate legal action. Play offensive and it will also be your defence at the same time. Proceed with caution.
