Aap per hearing fees de rahe hai toh technically uss din hearing nhi hui aur aapka matter call nhi hua. Toh iss scenario me lawyers ko fees nhi deni chahiye. Par agar aapke payment structure me aise mention hai ki agar hearing na bhi ho toh uss case me bhi aapko fees deni padegi kyuki lawyer ne apni side se puri preparation kar rakhi hai tab iss case me aapko fees bhi deni pad sakti. In any case you should confirm with your lawyer regarding this.

Thank you for your query. In High Court matters, it is standard practice for a lawyer to charge for each appearance, as their time is allocated and they must be prepared to argue the case. The fairness of the fee depends entirely on the terms of your initial understanding or agreement. Given the repeated ineffective dates, it is both reasonable and your right to seek clarification from your counsel regarding the billing structure and the status of your case. As legal professionals, we have a duty of transparency to our clients. If you require an independent assessment or a second opinion on the matter, I am ready to give my assistance.

If there was no effective hearing then you are not duty bound to give full payment to your advocate because there's always a difference between an effective date on which arguments are there and non-effective dates on which just dates are given due to non-availability of the judge or any other reason.

Generally, these things have to be decided when signing the Advocate. For Instance, in My case if the case doesn't come up in HC I charge 20-40% of the amount. In your case if nothing's been decided earlier on then you will have to pay the whole amount. NOTE: Advocates have 90% idea if your case will come or not. No, you don't have to pay 1.2 lakhs if your case did not come up. Whenever a hearing is not effective, you can always talk to the lawyer and get the fee reduced. If the advocate does not agree, you always have the option to obtain an NOC from the advocate and appoint a new one.
