I am the complainant and submitted an application for further investigation after filling out the charge sheet, IO filed the chargesheet u/s 325 and 506  but in my petition, - I asked to add sections 452 and 34 as per the circumstance of the crime - to cancel the bail given by police as police submitted one document "crime acceptance by accused"  and section 452 is non-bailable, -   investigate other accused The accused has not yet taken bail from the court and will usually IO replies ?

No problem, if such an incident has happened and the police has not registered a case under that section, then you can add the section through the court in which you will have to give your evidence……………………

In the present case producing bail to the accused is a matter of right so the Investigating officer is not wrong on their behalf. Additionally, if you think the same that the investigation is incomplete and the accused should be charged with section 452 then you can approach the magistrate with the evidence for the same thing and if it feels just by the magistrate, demand for further investigation or even additional charges will be added. So yes, if the Magistrate directs IO will reply.
