Fraud in the name of opening Franchise

A person told he will open a franchise of cloud kitchen in Bangalore and took 10laks with repayment guarantee but it has been 1 year he has not opened it yet keeps on giving reasons but paid some partial amount as agreed in the agreement monthly tat too only 4 month due out of 10 month due ..his intention was to just take money and use it for his other ruining hotels not to open any kitchen here..How do I file a fraud case on him..How long does it take in court to get my money back?
