Framing of charges in 385, 389, 500
02-Feb-2025 (In Criminal Law)
How many days will it take to frame charges by trial court (here FIR was done after orders were taken U/S 156(3) ) after charge sheet is filed . total of 6 accused - 3 on ABA and 3 got bail after arrest
The time taken to frame charges by the trial court depends on various factors, including the court's workload and procedural complexities. Here’s the process:
Supply of Documents: After the charge sheet is filed, the court ensures that all accused are provided with copies of the charge sheet and other relevant documents as per Section 207 of the CrPC. This step may take a few days to weeks.
Appearance of All Accused: All six accused must appear before the court. For those on bail or anticipatory bail (ABA), their presence is mandatory unless exempted by the court.
Arguments on Charges: The prosecution and defense will argue on whether prima facie charges are made out against the accused. This stage depends on how promptly the parties present their arguments.
Framing of Charges: Once the court is satisfied that there is sufficient ground to proceed, it will frame charges under Section 228 of the CrPC (in sessions cases) or Section 240 of the CrPC (in warrant cases).
In general, the process may take a few weeks to a couple of months after the charge sheet is filed. Delays may occur due to adjournments or procedural issues.
