For quashing of FIR. Please suggest.

Sir,I had an affair with a girl in 2009 to 2014.we love each other but there is no promice of marriage in our love relationship. in our relation physical relation is done by both of permission In varios hotel , hotels are booked by her. From 2015 she forced me to marry but my cast is hindu and she is Christian so its was not possible. I married another girl before 8 month ago.now she file fir against me u/s 376 504 506 ipc. Sir My question is that should I go for squashing of fir in high court?

Your background is not clear from your question. If both of you are adults who are educated and are capable of taking independent decisions then the allegations against you will have no grounds. You can certainly proceed for FIR quashing.

Hi,

You should definitely try and quash the FIR. I cannot comment on the merits of your particular matter but from what you have stated, it can be a good case. Please remember that once the charge sheet is filed, the HC will generally not entertain a Petition for quashing. So do it when only the FIR is there.

Yes you should go for quashing if the chargesheet has not come out. Other wise writ route is suitable. In these cases the intention and other factors have to be taken into consideration. I would suggest you take legal advise immediately to ensure that otherside does not take any adverse orders.
