CBI Submitted charge sheet on 28.03.2025 at the sessions court, Bhopal. Till now chargesheet not served by the court due non observance of cognizance.
Is it better to wait sometime or to go Jabalpur High Court to quash FIR.
U should file for quashing of FIR even if cognizance has not been taken .It is better to file 482 /528 for quashing the FIR because u would have many grounds for ur defence in the charge sheet itself.U can contqct me for any help.
Since the charge sheet has already been submitted by the CBI on 28 march 2025 but cognizance has not yet been taken by the Sessions Court, the matter is at a crucial procedural stage. Filing a quashing petition under Section 482 CrPC before the Hon'ble High Court of Madhya Pradesh at Jabalpur may be considered only if strong legal grounds exist, such as abuse of process, absence of prima facie case, or violation of fundamental rights.
However, before proceeding, it's important to review the charge sheet contents and the specific allegations.
You have the right to approach the High Court directly for quashing the FIR at any stage before or after charge sheet, before or after cognizance under Section 482 CrPC. However, the grounds for quashing must be strong, such as the FIR being baseless, abuse of process, civil dispute given criminal color, or a clear lack of evidence. The stage of the proceedings is not a legal bar to seeking quashing. In fact, it may be advisable to approach sooner rather than later if you have valid grounds, as prolonged delay itself rarely results in quashing.
what are the case details, please share the details of the case, case is listed under which section only then it will be wise to guide you but as of now first of all you must share the he is details or the case number with me so that I can help you
Ye situation procedural stage pe atki hui hai. Isme aapke paas do main options hote hain:
1. Wait & Watch Approach
Agar aapko lagta hai ki Court cognizance lene me procedural delay kar rahi hai (jaise scrutiny, defects, registry delay), to thoda wait karna faydemand ho sakta hai.
Kabhi-kabhi judge ya registry ke delay se hi charge sheet serve hoti hai, aur is beech me koi coercive step nahi hota.
Risk:
Jaise hi cognizance li jati hai, Court aapko summon/notice issue karegi.
Us stage pe aapko turant strategy tayar karni padegi (anticipatory bail / discharge / quash).
2. Jabalpur High Court me Quash Petition (S. 482 CrPC)
Agar FIR/charge sheet prima facie hi malicious, without evidence, jurisdictionally defective ya abuse of process hai.
Agar CBI ki investigation me koi glaring illegality hai (jaise sanction ka absence, mandatory approval ka violation, procedural irregularities).
Agar delay ka misuse ho raha hai aapko pressure me lane ke liye.
Benefits:
High Court agar satisfied ho jaye to FIR ya proceedings quash ho sakte hain.
Cognizance lene se pehle approach karna kabhi-kabhi strategically better hota hai kyunki case “pre-trial” stage me hota hai.
Practical Suggestion:
Pehle apne advocate se CBI charge sheet ki certified copy ya at least gist le lo (CBI ke through mil sakti hai even before court serves).
Agar aapke paas strong legal grounds hain to wait karne ke bajaye turant quash petition file karna safer hai, kyunki ek baar cognizance le li gayi to “quash” ke chances thode kam ho jate hain (phir trial discharge stage pe fight karni padti hai).
Lekin agar grounds weak hain aur aapka naam peripheral role me hai, to thoda wait karke discharge application se bhi relief mil sakta hai.
