FIR Not registered against the accused
30-Nov-2023 (In Criminal Law)
When a common man is no able to get his FIR registered because of the other party's influence, what is the recourse left? Under which section of CrPC he can approach to a court including High Court?
Dear Sir,
If FIR is not registered by Police then you may approach the Magistrate by filing Private Complaint under Section 200 Cr.P.C and get it referred under Section 156 (3) of Cr.P.C then therr are bound to issue FIR. Alternatively, you may approach High Court under Section 482 of Cr.P.C. which issues direction to Police to register FIR and to investigate.
