Financial Fraud by making Duplicate Bank Account

Accused Manage to opean A Fraud/Duplicate Bank Account in the name of Our NGO/ Club. He did transfar & withdraw money around 2 crore by this Fraud Account. Our NGO/Club President has case a file on session Court . Me(as Secretary) of that NGO can I file another case on High court (Kolkata). As session court hairing date nest date after 8 Month. Our NGO really need this money other wise lot of poor child will suffer.

Hello, I have gone through your query but I need a few more details so that I can help you. Like the details of the Sessions Case and under which sections the matter has been filed. Its not possible to register a case like that before the High Court its not a Court of Original Jurisdiction in Criminal Matters its an Appellate Court. My team will get back to you shortly. In my opinion without detail discussion and document review proper consult is not possible. Proper consult is possible only after reviewing all documents related to you case and if any order passed by Session Court.

your remedy lies before the magistrate court and not session court. and high court has no business in such matters on its appellate side unless the lower court first decides the case on merit. you can only come to the high court for police inaction if the police shows laches in submitting the chargesheet after proper investigation and that case can be filed by you representing your NGO. in fact the session court should have been also registered by you as secretary is the person who can duly represent the NGO before the court of law. since you have not listed out all the details of the IPC that your manager is charged with I'm not very sure the gravity of the offense and if it's confined to only cheating and criminal breach of trust and misappropriation then to my understanding the remedy lies before the magistrate court irrespective of the amount of money involved. which NGO? I want to work for NGOs as pro bono.
