Falsely accused of asking dowry as we called off marriage

We were yet to be engaged, but we called off marriage as girl was abusive and threatened with sending jail as i shared her number with my sister. After we called off marriage, (even engagement was not held), they have filed police complaint under IPC 420/406 falsely accusing that they gave Rs 5.5 lakh cash to us and i was further demanding Rs 10lakhs. I have call record where the girl uses foul words against me and says that she is cancelling the alliance from her end. We did not take or ask anything directly/indirectly and my family has all expenses in form of electronic trail. Please help

Dear Sir You have not indicated that as to how the informant/complainant made payment of Rs.5.5 Lakhs. First and foremost course of action against the allegations so levelled would be take anticipatory bail by materials showing that the allegations are false. Another course would be to go for quashing of the case provided there exists ground for the same, which can be determined only upon seeing the FIR/complaint. Regards

First file anticipatory bail for yourself and your family members so that you may get protection from being arrest and further, try to cooperate with your investigation officer with all the evidence that you are having against the said girl.

File an informatory petition in the court saying that u have doubt and fear that she will falsely implicate in a forge case of dowry demand against u and ur family as she had already filed a complaint in the police station...

Well,as you told case already has been lodged against now you fully co-operate the police/ investigating officer, stating entire facts & situation with relevant proof. You may also contact with higher officer. Moreover in between you may contact with lawyer to file A.B.P. Now a days without primafasci evidence police will not arrest you in this type of case, ultimately your question is concerned with Dowarry demand. Our Apex court has passed various guidelines to prevent the misuse of sec.498 IPC. Please consult your lawyer. Thanks
