Falsely accusation of stealing phone. How to defend myself?

What can someone do if you get accused for stealing a phone, then start beating until he hear you accept that fact which is not true.

It is not new that some rough guy without any basis or substance made an unfounded allegation on the naive and suave person. No one can beat you even if he thinks that you are the culprit, at max he can lodge an FIR against you and then police will do the investigation. You don't have to worry we can discuss your case in detail.

You have not provided any details about the incident so it would be difficult to precised advice but as per your query you should always call police on 100 no or give complaint in written to your nearest police station.

You can file case for false claim and more as per evidence act you disclosure statement by police is not valid in-law . You can file a opporiate case and it ur case of bonafide purchaser sec 411 IPC doesn't make u guilty . Prove all before high Court us.482.

Legal remedy with respect to your confession will largely depend upon the person before whom you have made such a confession.

If you have confessed the commission of crime before the police while in the custody then your confession to guilt can be treated as evidence only if it's recorded by a magistrate under Section 164 of the criminal procedure code (CrPC), after abiding by a set of precautionary conditions to ensure that it is voluntary and including that you will not be sent back to police custody after making such a statement. Section 25 of the Indian Evidence Act, 1872, currently unambiguously provides that all confessions made to a police officer will be inadmissible in court.

Theft is defined under section 378 IPC, and it's a non Bailable offence that means if the police finds merit and confidence in FIR against you then you can be arrested.
