False selling with hiding charges

08-Jan-2026 (In Criminal Law)
I bought a membership in 45000 Rs. from a hospitality company which provides around 70 days/nights stay in hotels in timeframe of 5 years. They didn't tell us about AMC charge of 14000 yearly, which is cheating and fraud. I haven't used any service and asked them for refund, But they refused and said that I have to use their service atleast for once and only after that they may think of cancelling and then also they will refund only half amount. What can I do for full refund?

If the AMC charge of ₹14,000 per year was not disclosed to you at the time of selling the membership, it amounts to unfair trade practice and deficiency in service. You are not bound to use the service even once if consent was obtained by hiding material facts. Their condition of “use once, then refund only 50%” has no legal force if such terms were not clearly explained and accepted by you in writing. You should first send a legal notice demanding full refund of ₹45,000 on the ground of misrepresentation and cheating. Simultaneously, you can file a Consumer Complaint before the District Consumer Commission seeking full refund with interest and compensation for mental harassment. Since no service has been availed, your case is strong. If there is clear evidence of cheating or false promises, a criminal complaint for cheating can also be considered. Preserve all receipts, brochures, recordings, emails, and messages. Consulting a lawyer with documents will help you take the correct and effective legal remedy for full refund.

have you signed any written contract with the company, because if there is any such conditions provided in it then he is violating the contract and you are entitled to compensation as well as refund otherwise not. moreover you can also file a complaint before consumer forum.

You are legally entitled to a full refund, and the company’s condition of “mandatory usage before cancellation” has no legal sanctity. Immediate consumer proceedings are the most effective remedy. Advocate Paras Shukla High Court of Madhya Pradesh, Jabalpur
