False molestation case by female employee

15-Sep-2025 (In Criminal Law)
A false case initialized by a female employee u/s 74,79 BNS due to non payment of salary. I also registered a counter case in police station. Police was pressuring me to pay salary to avoid molestation case which I refused. Non payment of salary was due to her deliberately avoiding all duties. Pay salary to avoid molestation case is proof enough that it's a false case. I have email, whatsapp and call recording proofs with me. I want to know how to quash this case / FIR and also punish this lady

File a quashing petition u/s 528 BNS with all supporting evidence. We can also file a criminal complaint as a counter case for giving false information to public servant and intent to injure. At the same time we can approach labour court where she refused to work, violated terms of contract which include attendancr records, warning emails,

punishment will not happen...yes quashing is possible... harass her by counter case ... I also believe that it will be tough to prove that you are innocent, we will need to file stay petition side by side with quashing...

dear client as per your query since the FIR is lodged and you want to apply for quashing of the case quashing can only be applied in High court if the lady has filed a case against you then you can file a defamation case against her..

Hello, You can surely go for a quashing of the FIR if you feel that there are concrete materials. Have you received any notice by the Police or have you taken a bail from the Learned Court as based upon this, the prayers will differ before the Hon'ble High Court.

Legal Steps Summary: File quashing petition under Section 528 BNS with all evidence. File counter complaint against false complaint under IPC Section 182/211. Pursue labor court case for breach of contract and non-performance. Use recorded proof and documented communication as key evidence. Seek punishment under BNS IPC provisions for false evidence and false complaints.
