False forgery case filed what to do.

IT is in low court .It is forgery case petitioner is state government and respondent are X AND Y under section 420,409,467,468,471,201,31 X is who withdraw a money and Y is principle of school without Y sing and seal money cannot withdraw Y says i have not done sign X says i dont know how money has withdraw there are total 46 witness one says at favor of Y and one says in against and remaining says they dont know . Signature expert says that sign did not match with Y sign . So how I should prove Y is not guilty

Since you have not stated your facts clearly it becomes tough for us to tender correct advice .. money has been withdrawn by X allegedly but the signature is of Y then if it's not an old transaction cctv might help u as it will provide you the link to reach to the perpetrators so ask your bank to provide the cctv footage of the relevant dates and then you can pursue easily

Guilt of accused can not be proved simply on the basis of a complaint...since cardinal doctrine of criminal jurisprudence runs in favor of accused till the conviction and the burden of prove is on the prosecution...since signature expert evidence and one witness evidence is in the favour of defence...so prima facie it appears that if the defence is put up in systematic manner, final argument is submitted by elaborating the evidence their admissibility and substantiating it with reverent Ratio laid down by the supreme court in this regard then I am the opinion that the accused will be acquitted... However exact view can be given by only going through whole case file...

When expert report is showing that sign does not match with y so how can state said that y is guilty. If y sign to withdraw money , he will do actual or real sign. And this is the mistake of bank that without matching sign how can they approve money.

You should raise only two points one is the experts report is not match with Y sign and second whether the y is the beneficiary and what was his earlier status from this case and 1 witness who is in favor of Y
