19-Sep-2023 (In Criminal Law)
No financial transactions but the informant forced the petitioner to sign on a promissory note and two other undertaking application to return Rs.20 lacs. Now the informant filed FIR on the basis of those documents. How to protect ourselves? Police is also a friend of that informant.

First of all the FIR or criminal case regarding promissory note or recovery of money should not exists. It is a completely civil dispute. Even if we assume that a person took money in promise to return it after a fixed period of time, the process of recovering it is through NI ACT. It cannot be recovered through police or by lodging any FIR.
