False FIR and civil criminal defamation case

A nationalised bank falsly alleged me and lodged an FIR. After that the police sent me to Judicial custody for more than two months. When I came out through bail, I filed a crl pet for quashing the fir. Now the said case is on hearing stage. So, please let me know if the FIR is quased can I file a defamation case against them. How much amount can i claim. And is there any option is available for Court fee waiver for filing defamation case.

Yes you can file a defamation case but in defamation case if you dont possess strict evidences it will go on for years and no remedies will be sought and more so court fee is generally Rs.100 at district courts. You must also need to find out why were you jailed, did someone pressurise for your arrests

yes you can file a defamation case. you can ask for any amount as compensation. just use the judgement of quashed FIR as a proof of defamation. and you can use the papers of your cases as the mental harassment and other harassment has been done to you wearing judicial custody. that's all.you can win the defamation case.

you can file a criminal case against the said bank before the local magistrate court u/s 200 CrPC for the offence punishable under section 500 IPC and u can file a suit for defamation claiming compensation of 1lack along with the litigation cost before the LD 1st civil judge senior division and for this u have pay a nominal court fees
