Fake signature in appeal in the High Court, how to object ?

12-Dec-2023 (In Criminal Law)
Hi Everyone, My husband has filed appeal into the High Court for quashing of the complaint case. As there is a total of 5 accused. The appeal is only filed with the name of my husband but I found that the notary was done to file the appeal into the High Court, wherein Solemn affirmation and affidavit my husband's name is written but it has my father-in-law's signature, not my husband's. They also got stay on the proceeding of the Lower court and it's our time to file the reply. But it is wrong, so I want to raise an objection. Please guide on how could I bring this into the eye of the HC? Thank you...

you are required to file reply to the proceedings of you are party to that , if you are not party to the proceedings then you can file an interim Application to add you as a party respondent there.
in the said reply you can put your contention there.

Well, your Husband wants to get a FIR & Criminal Proceedings quashed, that's why, he approached High Court. However, while filing the petition to quash FIR, your Husband had not properly signed during the time of affirmation. By bringing this to the notice of the Court, either your petition will get dismissed or court would direct your Husband to again go through the affirmation process if he wants to file a petition for quashing for and on behalf of all accused persons.
