Fake dowry and cruelty case. What should be my next step?

1. Wife filed fake case under 498a,323,504,506,3,4 charge sheet has been sent from Mahila thana to court for submission can she add fake 307 case in UP. 2. If I file for quashing as this is the totally fake case can we get stay on arrest in same appeal with quashing and what can be the expenses for the same. 3. How long maintenance cases run in DV or CRPC 125. On which facts basis Maitenance decide by court I have 2 daughters. 4. If wife is working but not having any proof can whatsapp discussion can be use as an acceptance or proof in the maintenance case. 5. What can be maximum punishment under above given allegations. What can be the best way to come out from such cases.

The best way as I have been dealing with the similar issues is to contest the suit on merit and as far as the maintenance part is concerned you can lower the maintenance amount by showing that the woman is working , if the the case is fake as you are saying than you can put the complainant for the strict proof for the same and if she is not able to lead any substantial proof than you may go for quashing under section 482 of the crpc and can invoke the inherent power of the high court enshrined under 482.

Preliminary opinion: As per your version of the matter it seems like you have a very disturbed marital relationship. Firstly, you should consult since a chargesheet has been filed in the case. The cost of litigation depend on the reliefs you seek. As in this case you might need an anticipatory bail. Then, we can move a petition in the family court for a settlement under the court's guidance, this might work but need the details of the case to give a definitive advice.
