A petition should be filed in the hc for quashing the summoning order immediately. If you belong to UP then the court will grant you time for applying for bail. Then you can apply for bail in the lower court.

At this stage you have no right to appear or oppose the application before court, court either dismiss the application r order to register FIR r treat the application as complaint case. Only after order by court you can challenge in high court under 482 crpc r writ.

Did you received summon in that matter? Or is it only registered? Actually judge Also satisfy himself on merit of the matter before registering a complain case and summon the accused or ordering to register FIR. In case the case is only filed without any merit or evidence, chances are there that it may get rejected. But in case u are summoned but the court then u must have to appear n fight it..
