Extortion, harassment and threats
12-Mar-2023 (In Criminal Law)
I shared a flat with a girl in bangalore who was the primary tenant of the house (the rent agreement is in her name). There was only a verbal agreement between us and no written agreement. There is no mention of me on the rent agreement as a sub tenant.
I paid her the deposit in full before moving in and shared 50% of rent and other expenses for my tenure. She refused to pay me the deposit despite a verbal agreement and I looked for replacing tenants to pay it to me.
Now, I cleared my dues and moved to a different city with my deposit and my luggage. But she claims that I have uncleared dues and should pay her some thousands of rupees. I didn't answer her calls and she is harassing my parents, threatening to file a police case against me. I have no outstanding dues towards her nor does she have a proof to support her claims.
What should I do?
Dear Sir,
You need not bother and just ignore such calls and on the contrary you just get issue a Legal Notice to her to repay your amount and further inform her that you are going to file a civil suit for recovery of money.

There is no fault of yours and hence you don't have to pay a single penny. Don't be scared of complaint as you can approach High Court under s 482 of CrPC and get complaint and FIR quashed as the matter is civil in nature. If you preserve conversation between you and her will be helpful in legal proceedings.

1. Do you have any call recordings, whatsApp chats claiming that you cleared all your dues?.
2. It is the civil matter. So, criminal action can not be taken against you.
3. I suggest you to issue legal notice to her for the recovery.
