Extorting money by threatening to "disturb" my family

20-Jul-2023 (In Criminal Law)
My wife's relatives are threatening to take "certain actions" that will affect my family and "disturb" them if I don't pay a huge amount of money to my wife and go for mutual divorce. I am not in favor of divorce. Does this amount to extortion, blackmail etc? What remedies do I have? Thank you in advance.

Dear Sir, Such things are normal in family life. You get issue a legal notice under Section 9 of Hindu Marriage Act and subsequently file petition for Restitution of Conjugal Rights. Further you may get file Domestic Violence Case through your mother against your wife and her family members. Thus you can protect yourself.

As per the facts it need to clarify whether your wife is employee under any organisation or she wants for her survival the amount. The meaning of extortion in most states is defined as the gaining of property, or money by almost any kind of force or threat of violence, harm to reputation and the meaning of blackmail is often defined as when the offender threaten to reveal information about a victim or his family member or member that is potentially embarassing. So if a wife threatens the husband for divorce, so that she can receive compensation. In a case it was considered as abuse of law, this provision of maintenance is being used as legal extortion. The legal steps you can take is you can issue a notice against her, can file a complaint at police station or directly in court. Try to collect evidence in the proof of extortion and cheating
