Evidence not produced before the accused as per CrPC 273

09-Jul-2023 (In Criminal Law)
The complainant does not produce any evidence although she appeared to the court 9 times during cross she mentions I will give but no evidence shared so far. This person has history of fabrication evidence. The cross examination will be completed by next hearing. Should I inform the metropolitan magistrate that the evidence needs to be given to me for verification during next hearing. Does giving evidence in the absence of the accused valid during trial?

Dear Sir, If no evidence is produced by her then the Court will not insist the Complainant to produce such evidence for your verification but the judgment will be pronounced in your favour. You cannot ask the Judge to direct the Complainant to produce evidence. If your Advocate give consent then only evidence in your absence may be recorded otherwise evidence cannot be recorded in your absence.
