You have to file a criminal petition in high court for stay on criminal proceedings and along with quashing the bald and baseless allegations filed against you by the police in the chargesheet . If the stay on criminal proceedings or quashing of FIR is not taken then you must face conviction!

Dear Sir, Once a charge sheet has been filed before the Sessions Court, the matter comes under the exclusive jurisdiction of the court, and the police cannot directly withdraw or modify it. However, since an internal inquiry has confirmed that wrong criminal sections were applied, there are effective legal remedies available to correct the error. You may file an application under Section 216 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (equivalent to Section 216 Cr.P.C.) before the Sessions Court. This provision empowers the court to alter, add, or delete any charge at any stage of the proceedings if it finds that the original charges were wrongly framed or not supported by evidence. It would also be helpful if you obtain a written report or affidavit from the Superintendent of Police confirming the findings of the internal inquiry and acknowledging the error. This document can be filed along with your application to strengthen your case.
