Does 377 act still apply If I file case

I went to police station and they refused to file FIR under 377 but they only took cognizance under 67a. But public prosecutor told to put it

Dear Madam, It seems the word of Public Prosecutor waves more as such the Police may register a case under Section 377 of IPC. If not obliged you may either approach higher authorities or file private complaint or wait till charge sheet is filed.
